This document sets out the terms and conditions (the “Terms”) between RM Advisory LLC (“RM Advisory”) and you (“Participant”) when you register for any event, conference, or activity (each an “Event”) organized by RM Advisory.

By registering for an Event organized by RM Advisory you are agreeing to comply with these Terms. You should read this document carefully.

Acceptance of Policies and Registration Conditions

The following Registration Terms apply to all RM Advisory Events. Upon or prior to your registration, you must acknowledge and accept the Terms contained herein. Should you not wish to accept the Terms, you should not register.

Submission of a registration is regarded as affirmation of your acceptance of these Terms.

How We Will Use Your Information

RM Advisory is committed to data privacy and protecting your personal information. Information on how RM Advisory collects, processes, and uses your data is included in the RM Advisory Privacy Policy, which is hereby incorporated into these Terms.

By submitting your name, email address, contact information, telephone number, or mobile telephone number during the Event registration process, you agree that RM Advisory and its event partners and sponsors may send you event-related information, including marketing of services and products which may be of interest to you.

A valid email address is required for all registrations. When you provide a mobile telephone number, you agree to be contacted by RM Advisory with event-related materials, including marketing texts or pre-recorded voice messages, unless and until you opt out of receipt of further marketing messages by texting “Stop” or a similar response to automated messages or texts.

RM Advisory is not responsible for any automated text, pre-recorded voice messages, or commercial emails sent by or on behalf of its sponsors. Sponsors of Events are responsible for compliance with applicable data privacy and security laws, including but not limited to CAN-SPAM and TCPA.

RM Advisory uses the personal data you provide in this registration for administering your participation in the Event. This may include information about the Event’s content, Event logistics, payment, updates, and additional information related to the Event.

RM Advisory may disclose your personal data to third-party service providers engaged by RM Advisory to assist in the conduct of the Event (such as payment services providers, venue operators, activity coordinators, etc.).

Information you provide when registering for or participating in an Event managed or co-sponsored by parties other than or in addition to RM Advisory may be shared with those parties, and the treatment of such information is further subject to the privacy policies of those parties.

Except as described herein, RM Advisory will not disclose your personal data to any other third party without your consent except where required to do so by law.

Nondiscrimination Policy

RM Advisory prohibits discrimination, harassment, and bullying against any person for any reason, for example, because of age, ancestry, color, disability or handicap, national origin, race, religion, gender, sexual or affectional orientation, gender identity, appearance, matriculation, political affiliation, marital status, veteran status, or any other characteristic protected by law.

Event Conduct and Safety

RM Advisory is committed to providing a safe, productive, and welcoming environment to all participants, including staff, vendors, and sponsors at RM Advisory Events. RM Advisory has no tolerance for discrimination, harassment, or bullying in any form at RM Advisory Events. Participants are expected to adhere to these principles and respect the rights of others.

What To Do If You Witness or Are Subjected to Unacceptable Behavior: Participants should report any behavior inconsistent with these principles to Event staff and/or to RM Advisory at legal@richeymay.com. Event staff will be happy to help participants and otherwise assist those experiencing harassment to feel safe for the duration of the Event.

Physical Activity Assumption of Risk

Certain Events may include physical activities such as sports, outdoor excursions, fitness sessions, team-building exercises, or other recreational activities (collectively, “Physical Activities”). By registering for and participating in any Event that includes Physical Activities, you acknowledge and agree to the following:

  1. Voluntary Participation. Your participation in any Physical Activity is entirely voluntary. You are under no obligation to participate in any Physical Activity offered during the Event, and you may decline or withdraw from any Physical Activity at any time without penalty.
  2. Acknowledgment of Risk. You acknowledge that Physical Activities involve inherent risks, including but not limited to the risk of bodily injury, disability, death, and property damage. These risks may arise from your own actions or inactions, the actions or inactions of others, the condition of the facilities or equipment used, or the nature of the activity itself.
  3. Fitness to Participate. You represent and warrant that you are physically fit and have no medical condition that would prevent or limit your safe participation in any Physical Activity you choose to undertake. You are solely responsible for determining whether a Physical Activity is appropriate for you given your health, fitness level, and any medical conditions. RM Advisory recommends that you consult with your physician before engaging in any Physical Activity if you have any concerns about your physical ability to participate.
  4. Compliance with Instructions. You agree to follow all safety instructions, rules, and guidelines provided by RM Advisory, its staff, or any third-party activity providers. You agree to use all safety equipment as directed and to immediately cease participation if you observe any hazard or feel unable to continue safely.
  5. Third-Party Activity Providers. Certain Physical Activities may be conducted by third-party providers engaged by RM Advisory. RM Advisory is not responsible for the acts, omissions, or negligence of any third-party activity provider. Your participation in activities led by third-party providers may be subject to additional terms, waivers, or releases required by such providers.

Liability Waiver and Release

In consideration of being allowed to register for and participate in the Event, including any Physical Activities, you hereby warrant and represent that you are of age in your jurisdiction and freely waive, release from liability, assume all risks, and covenant not to sue RM Advisory or its members, managers, employees, officers, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the Event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage, or property theft or actions of any kind is caused by the sole, gross negligence of RM Advisory.

Without limiting the foregoing, you specifically release RM Advisory from any and all claims arising from or related to your participation in Physical Activities, including claims for injuries sustained as a result of the condition of facilities, equipment, or terrain, the instruction or supervision provided, or the conduct of other participants.

This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given.

Alcohol Disclaimer

Certain Events may include the service or availability of alcoholic beverages. By choosing to consume alcoholic beverages at an Event, you acknowledge and agree that: (a) you are of legal drinking age in the jurisdiction where the Event is held; (b) you are solely responsible for your own alcohol consumption and behavior resulting therefrom; (c) you will consume alcoholic beverages responsibly and in moderation; and (d) RM Advisory shall not be liable for any injury, damage, loss, or harm arising from or related to your consumption of alcoholic beverages, including but not limited to accidents, injuries to yourself or others, property damage, or any other incident resulting from intoxication or impaired judgment. RM Advisory reserves the right to refuse service of alcoholic beverages to any Participant and to remove from the Event any Participant whose behavior, in RM Advisory’s sole judgment, poses a risk to the safety or well-being of themselves or others.

Service as an Invited Speaker

If you agree to speak at an RM Advisory sponsored Event, we may share your contact and biographical information with Event attendees. Sometimes we may also request a photograph.

In other cases, we post on the respective Event website information such as your name, employer, physical work address, work email address, as well as a link to your company website and/or professional LinkedIn page available to the public. This is so that visitors to the Event website, including Event attendees and speakers, can contact you with questions and requests for more information, and to provide feedback if needed. Speakers may be asked to complete a release agreement or copyright form prior to their presentation.

Credential/Badge Scanning During In-Person Events

If the Event requires in-person attendance, RM Advisory Event co-sponsors, exhibitors, and other third parties may directly request your personal information at their exhibit booths or presentations.

Providing your information to them is optional, and you should review their privacy policies to address your particular needs and concerns about how they will treat your personal information.

If during the Event you attend a session or program hosted by an exhibitor other than RM Advisory, you understand and agree that when you present your badge for scanning or when you provide personal data, that information will go to a non-RM Advisory entity, and RM Advisory takes no responsibility for how that company uses your personal information.

Usage of Photographic and Video Material

To comply with global data privacy laws, RM Advisory imposes certain restrictions on the use of multimedia at its Events (e.g., photography, video, audio, online streaming, recording of live virtual events, and all future mediums). An attendee is permitted to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed, or otherwise commercially exploited in any manner whatsoever.

RM Advisory may hire professional service providers (photo/video/streaming/audio) to document and display the Event experience. RM Advisory may also use social media to: (i) post real-time photos and videos to its social media feeds; and (ii) display select submissions from those feeds (virtual or on monitors) throughout the Event.

Attendees and sponsors are encouraged to capture their Event experiences and post their own social content from the Event (text, photos, audio, video, streaming), provided it does not infringe upon the rights of any attendee, sponsor, third party, or RM Advisory. Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights. In the event an attendee requires a release or permission to protect the rights of a third party, obtaining such a release or permission is the sole responsibility of the attendee.

By attending the Event, you acknowledge and agree as follows: (a) RM Advisory may edit and use footage or any recording it captures at or during the Event for marketing and promotional activities and for any other lawful purpose in the ordinary course of its business; and (b) due to the prevalence of recording devices in today’s world, RM Advisory disclaims all liability for the capture of your image in any multimedia format by other attendees at the Event.

General

RM Advisory reserves the right to change, amend, add, or remove any of the above Terms in its sole discretion and without prior notice. If one or more of the conditions outlined in these Terms should become invalid, the remaining conditions will continue to be valid and apply. These Terms apply to all Event Participants (attendees, speakers, sponsors, exhibitors).

The views expressed by any Event attendee, speaker, exhibitor, or sponsor are not necessarily those of RM Advisory. All attendees, speakers, exhibitors, and sponsors are solely responsible for the content of all individual or corporate presentations, marketing collateral, and/or advertising.

RM Advisory reserves the right to cancel, postpone, or modify the format of any Event, in whole or in part, at any time and for any reason, including but not limited to acts of God, severe weather, natural disaster, epidemic or pandemic, government order or regulation, civil unrest, terrorism, labor dispute, venue unavailability, or any other circumstance beyond RM Advisory’s reasonable control (each, a “Force Majeure Event”). In the event of such cancellation, postponement, or modification, RM Advisory shall not be liable for any direct, indirect, or consequential damages, costs, or expenses incurred by Participant, including but not limited to travel, accommodation, or other non-refundable costs. RM Advisory will make commercially reasonable efforts to notify registered Participants of any cancellation or material change to an Event in a timely manner. Any refund of registration fees, if applicable, will be provided at RM Advisory’s sole discretion.

To the maximum extent permitted by applicable law, RM Advisory’s total aggregate liability to Participant for any and all claims arising out of or relating to an Event or these Terms, whether in contract, tort, strict liability, or otherwise, shall not exceed the registration fees actually paid by Participant to RM Advisory for the applicable Event. In no event shall RM Advisory be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill, regardless of whether RM Advisory has been advised of the possibility of such damages.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or any Event shall be brought exclusively in the state or federal courts located in the State of Colorado, and each party irrevocably consents to the personal jurisdiction and venue of such courts. The Participant waives any objection to jurisdiction or venue in such courts, including any argument that the forum is inconvenient.

These Terms, together with the RM Advisory Privacy Policy and any additional terms or waivers presented at registration or at the Event, constitute the entire agreement between RM Advisory and the Participant with respect to the subject matter hereof. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to Event participation. No modification or waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of RM Advisory.
